The avoidance, management and resolution of disputes, particularly under construction contracts, is one of Ian's major professional preoccupations. There are various means by which resolution can be achieved from the facilitative to the determinative. Ian has decades of experience as an appointee and as an advisor across the dispute resolution spectrum.

A History of Arbitration 

Over the last 30 years Ian has had many appointments as an arbitrator in both single and joint appointments regarding major construction and commercial disputes. He is qualified as a Grade 1 arbitrator with the Institute of Arbitrators and Mediators Australia (IAMA). He has had extended involvement with this organisation, highlighted by his role as Vice President between 2004 and 2008.

District and Supreme Court References

Over his career, Ian has been appointed to many District and Supreme Court references. In this role, he has filed official reports, which have all been adopted, including in the Court of Appeal in New South Wales Building Insurers’ Guarantee Corporation vs. The Owners – Strata Plan No. 57504. [2010] NSWCA 23.

Mediations

Ian has conducted numerous Supreme Court and District Court referred mediations. He has frequently been appointed by the parties to mediate disputes or to facilitate the resolution of disputes, including major commercial multiparty disputes.

Expert Determiner

All New South Wales construction contracts, with government agencies, include a requirement for the resolution of disputes by the use of expert determination. Over the last ten years, Ian has conducted numerous such determinations with great success. Also, he has been appointed by parties in major commercial and construction disputes to act as an expert determiner.

Experience as an Adjudicator 

Ian is an accredited adjudicator under the Building and Construction Industry Security of Payment Act NSW (1999) and regularly conducts adjudications.
